Accountable Officer Selection Process Flowchart

The Accountable Officer Selection Process Flowchart is provided to assist a company in identifying its Accountable Officer, pursuant to the requirements of section 6.2 of the National Energy Board Onshore Pipeline Regulations.

The first step is to identify the person by name. This is usually the most senior person in the organization.

Then, a company can ask itself the following questions to confirm that this person is at the correct level in the company to be its Accountable Officer.

  • Does this person have final authority over all human resource matters?Footnote 1
  • Does this person have final authority over all financial matters?Footnote 1
  • Does this person have direct responsibility for the conduct and control of the company’s affairs?Footnote 1
  • Does this person have final authority over all operations activities?Footnote 1
  • Does this person have the final responsibility for all safety, security and environmental protection matters?Footnote 1

If the answer to any of these questions is “No”, then the person named is not at the correct level within the company to be the Accountable Officer. The selection process must start again using a different nominee.

If the answer to all of the questions is “Yes”, then the person named is at the correct level within the company to be the Accountable Officer.

If there is still any uncertainty concerning the named executive, asking the questions “Do they have the final decision?” and “Can they be overruled?” can assist. If the appointed person is an employee and/or reports to anyone who can overrule them then that person is not at the correct level within the company to be the Accountable Officer.'

If the answer to any of the questions is “No”, and if a clear selection cannot be made, the company can consult the CER. The company can contact the CER by writing a letter to the Secretary of the Commission, or calling at 403-292-4800 or toll free at 1-800-899-1265.
