Application for Variance of condition 3.c
The National Energy Board (Board) has reviewed the information filed in accordance with Condition 7.c of the Amending Safety Order AO-002-SO-T217-03-2010 (Amending Order) on 20 October 2016 and the revised information filed on 11 November 2016. The Board has also reviewed TNPI's request dated 27 October 2016 to vary the timing of Condition 3.c of the Amending Order.
First, the Board is of the view that the revised Commitment Plan filed on 11 November 2016 satisfies the tracking and reporting requirements of condition 7.c. Therefore, the Board approves the revised Commitment Plan.
Second, the Board has considered TNPI's application to vary condition 3.c and the additional information provided on 11 November 2016. The Board is satisfied that the timeline for filing the Engineering Assessment can be extended. Further, the Board notes that all other requirements of Condition 3.c in the Amending Order continue to apply. Therefore, pursuant to subsection 21(1) of the National Energy Board Act, the Board extends the filing deadline for the Engineering Assessment required by Condition 3.c from 31 December 2016 to 30 June 2017. For greater clarity, the subsequent Engineering Assessment required by Condition 3.c is due by 31 December 2017.
