IN THE MATTER OF THE NATIONAL ENERGY BOARD ACT,
AN ORDER UNDER SECTION 51.1

is a person involved in conducting an excavation or construction on or near a facility located at Information not available, Quebec.

On 6 October 2014, 1045 hours (MST), the undersigned National Energy Board Inspection Officer received information from Montreal Pipelines Ltd./Portland Pipeline Corporation that the above landowner was involved in conducting unauthorized excavation activity within 30 metres of the Montreal Pipeline Ltd. pipeline(s) and did not cease activity when requested to do so by Montreal Pipeline Ltd at the above noted address on 6 October 2014.

The Inspection Officer has reasonable grounds to believe that: As this excavation activity is unauthorized, the work was conducted in contravention of the Pipeline Crossing Regulations, Part I (Regulations), and the work will continue in contravention of the Regulations.

Based on the above mentioned, the inspection officer has reasonable grounds to believe that a hazard to the safety or security of the public, or employees of a company or a detriment to property or the environment is being or will be caused by the construction, operation, maintenance or abandonment of the pipeline, or excavation activity or construction of a facility as per 49(2)(a).

Therefore, Information not available is HEREBY ORDERED, pursuant to sections 51.1 and 51.1(2) of the National Energy Board Act, to

 X take measures specified below for guarding the safety or security of the public or employees or protecting property or the environment
 X Suspend work until the hazard or detrimental situation has been remedied to the satisfaction of the inspection officer; or the order is stayed or rescinded by the Board

Specified Measures:

Until such time that it can be verified that the proposed work can be resumed in compliance with the Regulations and without jeopardizing the safety of the public and the environment, the Inspection Officer orders that the recipient of this Order cease all excavation activities within 30 metres of the Montreal Pipelines Ltd., and not engage any contractor to conduct work on his behalf. The landowner is to provide written verification to the Inspection Officer that he will work in compliance with the Regulations no later than 20 October 2014.
