Panel Members - Biographies

Gaétan Caron

Gaétan Caron, Chair and CEOGaétan Caron was designated Chair and CEO of the National Energy Board of Canada (Board) on 20 September 2007. Prior to assuming that role, he was Vice-Chair of the Board, having been appointed on 1 January 2005. In 2003, he was appointed member of the Board.

Gaétan joined the staff of the Board in 1979. He has assumed a number of responsibilities at the Board, including those of Chief Engineer and Director, Financial Regulation. From 1994 to 2003, he held the position of Chief Operating Officer, being accountable to the Chair for the Board's overall capability and readiness to meet strategic and operational needs.

Gaétan obtained his Bachelor of Applied Science degree in Rural Engineering from Laval University in 1979 and his Master of Business Administration degree from the University of Ottawa in 1987. He is a member of the Québec Order of Engineers and of the Association of Professional Executives of the Public Service of Canada. He serves as Co-Vice Chair of the Committee on International Relations and is a member of the Committee on Gas of the National Association of Regulatory Utility Commissioners (NARUC). He has been actively engaged in the work of the Calgary United Way notably as a member of its Board of Directors from 2002 to 2009.

Georgette Habib

Georgette Habib, MemberMs. Habib holds a Bachelor's degree in Mathematics from the American University of Beirut and a Master's degree in Economics from the University of Alberta.

Ms. Habib joined the National Energy Board as a Member in October 2006. Prior to that Ms. Habib spent 24 years with the Alberta Energy Resources Conservation Board (ERCB) and her last position was as Manager of the Economics Group. During her time with the ERCB, Ms. Habib acted as a panel member at public hearings and provided expertise and advice to the Board on regulatory and policy issues.

Ms. Habib is the Chair of the National Energy Board’s Regulatory Policy Committee. As well, she is currently the Chair of the Canadian Association of Members of Public Utility Tribunals’ (CAMPUT’s) Energy Resources Committee.

Ms. Habib has also lectured intermediate-level courses in micro and macroeconomics at the University of Calgary.

Lyne Mercier (Vice-Chair)

Board Member – Lyne MercierBiographical Snapshot:

  • Before joining the NEB, Ms. Mercier worked at Gaz Métro for over 29 years, serving 10 years in executive positions. At Gaz Métro she was Director of the gas supply division, where she was responsible for strategic policy related to natural gas supply and, for the management of natural gas transmission, storage and supply contracts. Prior to that, she was head of the pricing division, where she was responsible for toll design and cost-of-service allocation studies.

Professional Affiliations, Degrees and Distinctions:

  • Bachelor of Commerce, St. Mary’s University.
  • Executive MBA from l’École des Hautes Études Commerciales.

List of Issues

The Board has identified but does not limit itself to the following issues for discussion in the proceeding.
The following strategic issues relate to the consideration of TransCanada’s Restructuring proposal and any alternative proposal(s) (Proposals):

  1. Appropriateness of setting, or the obligation to set, Mainline tolls based on the historical regulatory compact, with recovery of a full traditional cost of service, in the current circumstances.
  2. Effectiveness and durability of Proposals in supporting an economically sustainable Mainline.
  3. Appropriate allocation of risks and rewards among TransCanada, Mainline shippers and other stakeholders and the extent to which the Proposals align with this allocation.
  4. Whether it should be a goal or objective to effectively connect the Western Canada Sedimentary Basin to Eastern markets, and the extent to which the Proposals do so.
  5. Alignment of Proposals with relevant tolling principles.
    The following issues relate specifically to TransCanada’s application and may relate to any alternative proposal(s):
  6. Appropriateness of each of the Business and Services Restructuring Proposals and the components thereof, including:
    1. Depreciation Proposal;
    2. Alberta System Extension;
    3. Toll Design Proposals;
    4. Services and Pricing Proposals.
  7. Fair Return for the Mainline for 2012 and 2012 and 2013.
    1. Business risk;
    2. Cost of capital estimation;
    3. Setting the rate of return and treatment of debt costs.
  8. Appropriateness of the proposed Mainline rate bases, revenue requirements and components thereof for 2012 and 2012 and 2013.
  9. Appropriateness of the "flow through" elements of the 2011 Mainline revenue requirement, including the continuing prudence of TransCanada’s Transmission by Others arrangements and the amount of "used and useful" rate base.
