Important Notice: Termination of the Saint John River Wet Crossing Proceeding

In a letter filed on Wednesday, 22 October 2008, the NEB accepted the request submitted by EBPC to terminate the Wet Crossing Hearing Application as it is no loger required. Consequently, the hearing scheduled to start in December 2008 will not be taking place as planned.

Introduction

The NEB received Emera's Wet Crossing Application on 13 December 2007.

On 12 February 2008, the Board issued a letter soliciting comments from the public with respect to the issues that should be considered relevant to this application. In its letter, the Board was also inviting individuals to indicate their interest in participating in the process which the Board would establish to consider the application.

In a letter issued on 20 August 2008, the NEB announced the decision to postpone the public hearing from the previously scheduled date of 9 September 2008 to 9 December 2008. This postponement will allow the applicant, Brunswick Pipeline Company Ltd, enough time to determine whether or not it will be successful in completing the horizontal directional drill (HDD) work, which is already underway. The final outcome of the HDD work will determine the need to proceed with the Wet Crossing hearing.

Should this hearing proceed, the Board has identified, but does not limit itself to the following issues for discussion:

  • The potential environmental and socio-economic effects of the proposed facilities, including those factors outlined in subsection 16(1) of the Canadian Environmental Assessment Act.
  • The suitability of the design of the proposed facilities, including but not limited to safety and integrity.
  • The need for the proposed facilities.
  • The terms and conditions to be included in any approval the Board may issue.
