Introduction to Info Source

Info Source: Info Source describes the programs and activities, and the information holdings related to programs and activities, of government institutions subject to the Access to Information Act to facilitate the right of access. It also provides individuals, including current and former employees of the Government of Canada, with relevant information to access personal information about themselves held by government institutions subject to the Privacy Act and to exercise their rights under the Privacy Act.

The Access to Information Act and the Privacy Act assign overall responsibility to the President of Treasury Board (as the designated Minister) for the government-wide administration of the legislation.

Infrastructure, Tolls and Export Applications

The Canada Energy Regulator (CER) makes decisions and recommendations, which include impact assessments, on applications to construct, operate, decommission, and abandon pipelines, offshore renewable energy, and international and designated interprovincial power lines. The CER also makes decisions on applications for pipeline tolls and tariffs so that they are just and reasonable, applications for compensation disputes resolution, applications related to oil and gas exploration and drilling activities and infrastructure in certain northern and offshore areas of Canada, and applications for the export of oil, natural gas liquids, electricity and the export and import of natural gas. Participants in program processes include the applicant, interveners and commenters, or in the case of formal complaints received by the CER, all parties to the complaint.

  • Public Hearing Process Class of Record
    Description:     Includes records related to the public hearing process facilitated by the CER before the CER makes a decision on an application for a major project. Stakeholder opinions can be gathered in writing or through a combination of written and oral submissions. Most of the information collected under this initiative will be available for public view on the CER website. After the close of the public hearing, the CER will either issue Reasons for Decision or a CER Report.

    • Hearing Participation Personal Information Bank
      Description:       This bank contains the applications to participate, interventions and letters of comment filed with the CER by companies, groups, and individuals who have participated in the CER's regulatory proceedings. All such documents form part of the record of proceeding, and the vast majority are public and available on the Board’s website. Documents may be retrieved by providing the name of the application to which the document relates and the name of the participant.
      Class of Individuals: Persons, groups or companies who have participated in the regulatory proceedings of the CER.
      Purpose: For consideration of these submissions by the Board in arriving at quasi judicial decisions on applications before it.
      Consistent Uses: To maintain a record of all applications to participate, interventions and letters of comment filed with the Canada Energy Regulator, relating to any applications. In the vast majority of cases, disclosure is on request because the vast majority of these documents are public.
      Retention and Disposal Standards: Documents retained for 40 years then the status of the facility is reviewed. If the facility is decommissioned and retention is applied then files are passed to the National Archives of Canada to become part of the history of Canada.

Participant Funding

The Canada Energy Regulator (CER) Participant Funding Program provides funding to facilitate the participation of interveners – and, in particular, the Indigenous Peoples of Canada and Indigenous organizations – in eligible public hearings and any steps leading to those hearings.

    • Participant Funding Program Personal Information Bank
      Description:       This bank describes information collected in support of the CER's Participant Funding Program (PFP). The personal information may include name, contact information, biographical information, financial information, signature, and views and opinions of, or about, individuals. Class of Individuals: Individuals requesting funding under the PFP.
      Purpose: The personal information is used to administer the PFP and disburse funds in respect of the participant funding. Personal information is collected under the authority of 16.3 of the CER Act.
      Consistent Uses: Information, including the identity of the individual and the amount of funding received will be posted on the Agency’s proactive disclosure website, consistent with the requirements in the Directive on Proactive Disclosure. Information may be used for reporting to senior management, program evaluation, audit and evaluation. Personal information is collected for managing the Conflict of Interest and Post-employment Guideline and for the reimbursement of debts owed to Crown.

Safety and Environment Oversight

Company Performance

The Canada Energy Regulator (CER) holds its regulated companies accountable for meeting regulatory requirements and project-specific conditions to prevent incidents and provide for the safety of Canadians and the protection of the environment during the construction, operation and abandonment phases of a project lifecycle. This includes requirements for companies to have adequate funds for abandonment. The CER undertakes risk-based Compliance Verification Activities to determine company compliance with regulatory requirements in the technical areas of security, environmental protection, pipeline integrity, safety management, damage prevention, rights and interests, and financial regulation.

Management Systems and Industry Performance

The performance of the regulated industry results in energy infrastructure that is systematically reliable and safe for people, the environment, and property. The Canada Energy Regulator (CER) requires companies to continually evaluate and improve the effectiveness of their management system and to implement corrective actions to prevent incidents. Where required, the CER investigates and enforces regulatory requirements to prevent harm and acts to compel learnings for further system improvements. The CER requires companies to promote a positive safety culture to effectively manage threats to worker health and safety, and process safety. Information acquired from this work is used by the CER to continually improve its regulations and practices.

Emergency Management

Through its Emergency Management program, the Canada Energy Regulator (CER) holds its regulated companies responsible for anticipating, preventing, managing and mitigating conditions during an emergency and for cleaning up and remediating contamination to CER requirements and expectations. This also includes requirements for companies to have financial resources to pay for spill costs and damages. The CER promotes the effectiveness of the broader response through mutual agreements and information sharing with all levels of government, including municipalities and First Responders.

The Canada Energy Regulator (CER) studies energy systems to inform its regulatory decisions and share energy market information with the public. The scope of CER energy market reporting is diverse and includes traditional oil, gas and electricity information, as well as renewable energy, the role of emerging technologies, and the links between energy, economic, social, and environmental issues.

Internal Services

Internal services constitute groups of related activities and resources that are administered to support the needs of programs and other corporate obligations of an organization. Internal services include only those activities and resources that apply across an organization and not to those provided specifically to a program. These groups are management and oversight services, communications services, legal services, human resources management services, financial management services, information management services, information technology services, real property services, materiel services and acquisition services.

Acquisition Services
Acquisition services involve activities undertaken to acquire a good or service to fulfil a properly completed request (including a complete and accurate definition of requirements and certification that funds are available) until entering into or amending a contract.

Communications Services
Communications services involve activities undertaken to ensure that Government of Canada communications are effectively managed, well-coordinated and responsive to the diverse information needs of the public. The communications management function ensures that the public – internal or external – receives government information, and that the views and concerns of the public are taken into account in the planning, management and evaluation of policies, programs, services and initiatives.

Financial Management Services
Financial management services involve activities undertaken to ensure the prudent use of public resources, including planning, budgeting, accounting, reporting, control and oversight, analysis, decision support and advice, and financial systems.

Human Resources Management Services
Human resources management services involve activities undertaken for determining strategic direction, allocating resources among services and processes, as well as activities relating to analyzing exposure to risk and determining appropriate countermeasures. They ensure that the service operations and programs of the federal government comply with applicable laws, regulations, policies, and plans.

Information Management Services
Information management services involve activities undertaken to achieve efficient and effective information management to support program and service delivery; foster informed decision making; facilitate accountability, transparency and collaboration; and preserve and ensure access to information and records for the benefit of present and future generations.

Information Technology Services
Information technology services involve activities undertaken to achieve efficient and effective use of information technology to support government priorities and program delivery, to increase productivity, and to enhance services to the public.

Legal Services
Legal services involve activities undertaken to enable government departments and agencies to pursue policy, program and service delivery priorities and objectives within a legally sound framework.

Management and Oversight Services
Management and oversight services involve activities undertaken for determining strategic direction, and allocating resources among services and processes, as well as those activities related to analyzing exposure to risk and determining appropriate countermeasures. They ensure that the service operations and programs of the federal government comply with applicable laws, regulations, policies, and plans.

Materiel Services
Materiel services involve activities undertaken to ensure that materiel can be managed by departments in a sustainable and financially responsible manner that supports the cost-effective and efficient delivery of government programs.

Real Property Services
Real property services involve activities undertaken to ensure that real property is managed in a sustainable and financially responsible manner, throughout its life cycle, to support the cost-effective and efficient delivery of government programs.

Travel and Other Administrative Services
Travel and other administrative services include Government of Canada travel services, as well as those other internal services that do not smoothly fit with any of the internal services categories.

Classes of Personal Information

Office of the Secretary Files
In the course of its programs and activities the CER may accumulate personal information which is not contained in the specific personal information banks listed in this entry. Such information may include an individual's name, address, telephone number, or opinion on a specific matter. This data is stored as part of the general subject files and the records are not normally retrievable by the name of the individual or other identifier.

Such personal information is provided by individuals in requesting publications, general information, funds for projects they are conducting, or in providing their comments or opinions on various topics. To retrieve this type of personal information, the enquirer must state the specific subject matter of the correspondence, the name of the person, and the approximate date on which the correspondence was forwarded to the CER. The retention periods for these classes of personal information are controlled by the record schedules of the general subject files in which they are stored.
